Information pursuant to art. 13 of Regulation (EU) 2016/679, so-called GDPR (General Data Protection Regulation)

In this page, we describe how we use the personal data of the people who visit our site. This information (or "privacy policy") is provided pursuant to art. 13 of Regulation (EU) 2016/679, so-called GDPR (the "Regulation" or "GDPR") to those who interact with the web services of the site https://www.generalfruit.com.

The information refers exclusively to the www.generalfruit.com site and not to any other sites accessed by the user from links on our site.

  1. WHAT DATA WE PROCESS

Our site collects the following personal data:

 

Navigation data

The IT systems and software procedures necessary for this site to function correctly collect certain personal data, the transmission of which is implicit in the use of internet communication protocols, as part of their normal operations. This information is not collected in order to be associated with identified users, but by its nature it may allow for users to be identified when used and associated with data held by third parties. This data includes IP addresses or dominium names of the computers used to connect to the site, URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numeric code indicating the state of the response from the server and other parameters relating to the user's operating system and software environment. This data is used exclusively to collect anonymous statistical information on how the site is used, and to check that it is functioning correctly. If a computer crime is committed against our site, we may use the data to find out who is responsible.

 

Data provided voluntarily by the user

Through the site, users can voluntarily provide personal data, such as their name and email address, in order to request information and allow the data controller to provide its services through the site forms.

The personal data supplied in this way are used only to respond to the requests sent, and are communicated to third parties only if this is necessary for this purpose.

 

Cookies

No personal data concerning users are acquired by the website. We do not use cookies to transmit information of a personal nature, nor are so-called “persistent cookies” of any kind, or systems for tracing users. The use of so-called “session cookies” (which are not stored permanently on the user's computer and disappear when the browser is closed) is strictly limited to the transmission session identifiers (consisting of random numbers generated by the server) necessary to allow a secure and efficient exploration of the website.

 

  1. PURPOSE AND LEGAL BASIS OF DATA PROCESSING

The personal data you provide will be processed by the data controller exclusively for the following purposes:

  1. providing the services (sending information, services, or other material requested by you, etc.);
  2. meeting our legal obligations.

The legal basis for processing your personal data - which you provide the data controller for the purposes referred to in point a) - is to respond to your request for informative material or services.
The legal basis for processing your personal data referred to in point b) is to meet our legal obligation set out in art. 6, section 1, letter c) of the GDPR ("processing is necessary to fulfil a legal obligation to which the data controller is subject"). 

 

  1. DATA PROCESSING METHODS AND LOGIC

Your data is only processed when strictly necessary, either on paper or with the aid of electronic or automated means in compliance with the adequate technical and organizational security measures provided for by the GDPR, and is performed by General Fruit Srl  and/or by third parties employed by General Fruit Srl  to store, manage and transmit the data (for more details see point 5).

The personal data being processed are stored and controlled in such a way as to minimize the risk that they could be destroyed or lost, even by accident, or that they could be accessed or processed unlawfully, without authorisation and for purposes other than those for which they were collected.

 

  1. WHO COULD RECEIVE YOUR DATA

Your personal data may be communicated for the purposes specified above to subjects who perform activities necessary to provide the services offered by the site (for example, analysing the way the site works). These subjects are known as data processors (art. 28 GDPR), and/or as authorized persons acting under the authority of the data controller and the Data Processor (art. 29 GDPR), or as subjects specifically designated for processing data within the terms of the GDPR and the national regulation used to implement the GDPR; these could include IT or archiving service providers, other technical/organizational services, and the employees and collaborators of General Fruit Srl .Your information may also be communicated to third parties in order to fulfil the obligations established by Italian or European legislation in force and to allow General Fruit Srl  to defend itself in court (for example in the case of violations by network users).

The personal data provided will not be published.

 

  1. TRANSFERRING YOUR DATA TO A THIRD COUNTRY AND/OR INTERNATIONAL ORGANISATION

None of your personal data will be transferred to a third country outside the European Union or to international organizations.

 

  1. HOW LONG YOUR DATA WILL BE STORED, AND HOW WE DECIDE

Your personal data will be kept in accordance with art. 5, section 1, letter e) of the GDPR in a form that allows you to be identified for no longer that necessary for the purposes described in point 3 above, or to meet our legal obligations.

 

  1. YOUR RIGHTS AS DATA SUBJECT

Under art. 15 and following of the GDPR, you have the right to ask the data controller to:

Without prejudice to any other administrative or judicial appeal, if you believe that your data has been processed in breach of the GDPR, you have the right to file a complaint with a supervisory authority. This should be done in the Member State in which you normally reside and work, or where the alleged violation too place (art. 77 of the GDPR).

To exercise these rights, you can contact the data controller at the addresses indicated in point 1 of this policy.

 

  1. OBLIGATORY OR OPTIONAL DATA, FOR LEGAL OR CONTRACTUAL REASONS, AND WHAT HAPPENS IF YOU REFUSE

It is obligatory to provide your data in order to respond to your requests for information, and to allow the data controller to provide our services. If you refuse to provide your personal data, we will not be able to respond to your requests. 

 

  1. AUTOMATED DECISION-MAKING PROCESS

As per art. 13, section 2, letter f) of the GDPR, we inform you that the personal data collected will not be the subject of an automated decision-making process, including the profiling referred to in art. 22, sections 1 and 4 of the GDPR.

 

  1. DATA PROCESSING FOR REASONS OTHER THAN THAT FOR WHICH THE DATA WAS COLLECTED

If the data controller intends to process the personal data for additional purposes to those for which they were collected, before beginning processing, General Fruit Srl  will inform you about the additional purposes and provide you with all the relevant information under art. 13, section 2 of the GDPR.
